Welcome to YAMSE. By accessing or using our website, mobile app, or delivery services, you agree to comply with these Terms of Use.
1. Introduction
These Terms of Use (“Terms”) govern your access to and use of YAMSE’s website, mobile app, and services. By registering for an account, placing an order, or using the Services, you agree to these Terms in full. If you do not agree, do not use the Services.
2. Definitions
Company: YAMSE, providing errand and delivery services in Makurdi and Benue State.
User: Anyone using our Services.
Account: Your registered user account.
Order: A request for a Service.
Service: Errand and delivery services including grocery runs, parcel delivery, document handling, and custom errands.
Partner/Courier: Third-party or YAMSE engaged personnel performing deliveries.
Prohibited Items: Items that are illegal, unsafe, or restricted.
3. Eligibility
You must be at least 18 years old and legally capable of entering into contracts under Nigerian law to use YAMSE Services. We may refuse registration or suspend accounts if Terms are violated.
4. Account Registration & Access
Creating an account may be required for full access. You are responsible for safeguarding login credentials and must notify YAMSE of unauthorized use. We may suspend or disable accounts at our discretion.
5. Ordering & Service Provision
- You must provide accurate pickup, recipient details, item description, and instructions.
- Delivery times are estimates and not guaranteed.
- YAMSE may engage Couriers or partners to fulfill orders on its behalf.
6. Service Fees & Payment
Fees are determined by distance, urgency, item type, and other factors. Payment must be made via approved methods. Fees may change with notice. Transactions are final unless otherwise stated.
7. User Obligations
- Use Services lawfully.
- Provide accurate delivery information.
- Do not send illegal, restricted, or dangerous items.
- Respect privacy and property.
8. Prohibited Items
Items that cannot be delivered include illegal substances, explosives, weapons, firearms, perishable items requiring special handling, or any items restricted under Nigerian law.
9. Cancellations & Refunds
You may cancel orders within a specified timeframe. YAMSE may also cancel orders for safety or operational reasons. Refunds are processed via the original payment method where applicable.
10. Delivery, Risk & Title
Risk remains with the user until delivery is completed. You authorize Couriers to leave items if instructed. Inspect items on delivery and report issues promptly.
11. Limitation of Liability
YAMSE is not liable for indirect, special, or consequential losses. Liability for direct losses is limited to the order value. This does not affect liability for death, personal injury, fraud, or wilful misconduct.
12. Intellectual Property
All content, branding, software, and materials on YAMSE’s website and app are owned by YAMSE or its licensors. Unauthorized reproduction or use is prohibited.
13. User-Generated Content
You grant YAMSE a non-exclusive, worldwide license to use content you upload (reviews, photos, etc.). You represent that your content is legal and does not infringe third-party rights.
14. Privacy
Use of our Services is governed by our Privacy Policy, which complies with Nigerian data protection laws.
15. Third-Party Links & Services
YAMSE may include links to third-party websites/services. We do not endorse these and are not responsible for their content.
16. Governing Law & Dispute Resolution
These Terms are governed by Nigerian law. Disputes are subject to the exclusive jurisdiction of Nigerian courts. Parties shall attempt to resolve disputes via negotiation or mediation first.
17. Changes to Terms
YAMSE may update Terms. Continued use after updates constitutes acceptance.
